Lawfully,
it means throwing a prescribed number of
pebbles in a certain time and place.
There are three Jamarat. All are to be
thrown in Mina. They are: the smallest
Jamrah which lies
after Khayf Mosque, the middle Jamrah
and the big Jamrah or Jamrah Al Aqabah.
Its
legality:
Jamrah Al Aqabah is thrown on the day of
Nahr the three Jamrahs are to be thrown
for two days after the day of Nahr. The
four Imams and the majority of scholars
agreed on this, calling it essential.
Needless to say, the essential does not
reach the level of obligatory yet it
rises above the level of Sunnah. Thus,
if is unlawful to fail to it unless one
has a genuine excuse for it.
Nevertheless, he has to atone. Throwing
at the third day of Ayam At-Tashriq
(11th, 12th, 13th of Dhul Hijjah) is
optional. As such, the pilgrim is free
to throw them or not and he is not to be
held to account for it.
The allowed and Sunnah times for
throwing: It is allowed to throw pebbles
starting from the second half of the
night of the Youm Al Nahr (Sacrifice
day). 'Attaa, Tawous, Asho'abi, Ibn Abi
Leila, 'Akrema Ibn khaled, Ash-Shaf'i
and Ahmad held the same view. However,
it was reported that Ahmad was of the
opinion that it suffices for the pilgrim
to throw them at dawn when the first day
light spreads before the sun rise. He
added that it is not allowed for him to
throw them before daybreak. Malik,
Hanifa, Ishak and Ibn Al Mondher held
the same view. It is permissible yet
disliked to delay throwing pebbles until
after darkness, particularly if the
pilgrim has not a valid excuse to
justify his delay. If the pilgrim does
not throw Jamrah Al Aqabah until after
sunset on the 10th of Dhul-
Hijjah (the day of Nahr), he is allowed
to throw them at night if he has a
genuine excuse for his delay such as
fear of the stifling crowds sickness or
harm or if the means of transport he is
using breaks down or the like. If not,
this delay is disliked. Abu Hanifa,
Ishak and Ahmad were of the opinion that
if the pilgrim delayed the throwing of
pebbles till the end of the day of
sacrifice then he should not throw them
during the night, but during the next
afternoon of the second day of Eid. He
should then throw the Jamarat at the
prescribed time. Ash-Shafi'i and Ahmad
held that the time of throwing extends
until the sunset of the last days of
Ayam At-Tashriq (the 11th, 12th and 13th
of Dhul-Hijjah). It is a Sunnah on the
day of Nahr to throw Jamrat Al 'Aqabah
from the time of sunrise until the sun
passes its meridian and the time for
Dhuhr (noon prayer) begins.
The
time commended for throwing pebbles the
three days of At-Tashriq is from midday
until sunset. It is allowed to delay it
until the sunrise of the next day
without dislike. If there is no valid
excuse to justify this delay, it is
disliked. Annawawi stated that the time
for throwing pebbles extends until the
last day of the day of At-Tashriq.
However, the pilgrim may throw for the
whole three days on the third day of At-Tashriq.
It is not allowed to throw the pebbles
before sunset except in the third day of
the days of At-Tashriq. Abu Hanifa and
Ishak allowed throwing of the pebbles
before sunset providing that the pilgrim
does not depart from Mina until after
sunset. Attaa, Tawous, and Abu Jaa'far
Mohammad Ibn Ali allowed the throwing of
the pebbles before sunset or all the
days of throwing pebbles.
